Nancy Benoit Nude Pictures Shouldn’t Have Been Published, Court Rules

A federal appeals court ruled Thursday that Hustler Magazine was wrong for publishing nude photos of the wife of wrestler Chris Benoit. The nearly 20-year-old pictures were published last year, only a year after Nancy Benoit and her young son were murdered by Chris before he committed suicide.

Nancy’s family filed a federal lawsuit against the Larry Flynt Publishing Group last year. The lawsuit says Nancy, a model and former pro wrestler, requested the photos be destroyed right after they were taken.  

The 11th Circuit Court of Appeals ruled Thursday that a death does not give publishers the right to publish any pictures they wish.

Chris Benoit killed Nancy and their 7-year-old son Daniel in June 2007 before hanging himself. Police said Chris, 40, strangled Nancy, 43, and smothered Daniel in their Fayetteville, Georgia home.
